Man Sentenced to 19 Years for Imprisoning and Repeatedly Raping Elderly Mother in Spain

The Provincial Court of Cádiz has sentenced a man to 19 years in prison for mistreating and sexually assaulting his dependent mother

A 47-year-old man, identified only as Rafael CDVM, has been sentenced to 19 years in prison for sexually assaulting his 83-year-old mother, whom he held captive in their home in Chiclana de la Frontera, Spain. The victim, who has since passed away, endured near-daily rapes and physical abuse at the hands of her son.

The case came to light in spring 2023 when caregivers noticed blood stains on the elderly woman’s underwear and bruises on her body. Court documents revealed that Rafael had threatened to "kick" her and "rip" her head off. The victim had also confided in her caregivers, saying, "My little boy slept here today, and I don’t want him to. I don’t want him in my bed."

Despite being under constant surveillance by Rafael, the caregivers reported the abuse via email and text messages to their employer. Social services later intervened, and the victim disclosed that her son had been raping her almost daily. However, she died seven months after the investigation began, rendering her testimony inadmissible in court.

During the trial, caregivers, a social worker, and a forensic doctor testified against Rafael. His defense claimed he had an intellectual disability, but medical experts confirmed he was fully aware of his actions. The Provincial Court of Cádiz condemned his behavior, stating he created a "hellish and terrifying environment" for his mother, making her a "prisoner" subjected to his "whims and caprices of an aggressive nature."

In a separate case, a 27-year-old man, Santiago, was sentenced to 17 years for raping his seven-month-old daughter and distributing child pornography. The Venezuelan national, a waiter in Madrid, filmed the assaults and shared them on the dark web. Arrested in 2023, Santiago admitted to the crimes, claiming he "was sick and couldn’t stop." In addition to his prison term, he is banned from approaching his daughter and has lost parental rights for a decade.
