Conservative influencer Ashley St. Clair has filed a lawsuit against Elon Musk, seeking sole custody of their alleged son and requesting a paternity test from the billionaire.
Just a week after publicly revealing that she had given birth five months ago, St. Clair filed legal petitions in New York to establish Musk as the child’s father. The child, identified in court documents as “RSC”, does not have Musk’s name on his birth certificate, and the Tesla and SpaceX CEO has yet to acknowledge paternity publicly.
St. Clair is not seeking child support at this time—only legal recognition that Musk is the father. She alleges Musk has only seen the child three times since birth and has no involvement in his care.

“I am the only parent who cares for him on a daily basis,” St. Clair states in the filing. “I feed him, bathe him, and ensure that all his physical and emotional needs are met.”
Her legal team claims she attempted to resolve the matter privately, but Musk has been unresponsive.
Musk’s Alleged Response: “We Have a Legion of Kids to Make”
Court documents include text messages in which Musk allegedly acknowledges his son but argues against putting his last name on the birth certificate for “security reasons”.

“If I make a mistake on security, ‘R’ will never know his father,” Musk reportedly wrote.
In another message, when St. Clair attempted to settle their dispute, Musk brushed her off, saying, “We do have a legion of kids to make.”
The lawsuit comes amid growing scrutiny over Musk’s parenting, following a public plea from singer Grimes, who also shares children with Musk. Grimes recently posted on X, urging Musk to respond to a medical crisis involving their child, claiming she was unable to reach him.
Musk, who has fathered 12 children with three different women, has long advocated for high birth rates, calling population decline a crisis. However, St. Clair’s lawsuit and Grimes’ plea raise questions about his role as a father.
Neither Musk nor his representatives have commented on the lawsuit.
