The passenger who shot an aggressive attacker on a busy New York City subway will not face charges, prosecutors announced.


Oren Yaniv, a spokesperson for the Brooklyn District Attorney’s Office, emphasized the gravity of the incident in an email statement. He stated that while the investigation continues, evidence indicates self-defense, leading to the decision not to file criminal charges against the shooter.


“Yesterday’s shooting inside a crowded subway car was shocking and deeply upsetting,’’ said Oren Yaniv. “The investigation into this tragic incident is ongoing, but at this stage, evidence of self-defense precludes us from pursuing criminal charges against the shooter.”


As previously reported, the incident occurred on the A train around 4:45 p.m. Thursday at the Hoyt-Schermerhorn station.


The man who was shot, Dajuan Robinson, 36, had obtained the gun during the altercation, but the other man managed to take control of it and used it against Mr. Robinson, who was clearly the aggressor.


The situation escalated into a struggle over the weapon, leading the shooter, 32, to fire at Robinson, hitting him in the head. Robinson is currently in critical condition in the hospital, with uncertain chances of survival.
